CHILDREN OF PABTED PARENTS.

, A somewhat unusual application for the maintenance of two children was made before Mr. C. R. Orr-Walker, SM., at the Magistrate's Court. The position, according to Mr. W. E. Leicester, was that his'client, the plaintiff, was now a Mrs. Newjon, but previously she had been the wife of the defendant, a tramway employee, named James Graham, who had divorced her for adultery, naming Newton as the co-respondent! ISo agreement was come to at the time in regard to the custody of the two children. It was arranged, however, that the matter should be left open, with leave for either party to apply to the Court, but no application had been made by Graham, the father, who contributed nothing towards the support of tho .children. Counsel submitted that the mother was not' liable for the maintenance so long as the children ' remained with her, but the legal father should be bound to contribute until the Supreme Court, deemed otherwise.

Appearing for the defendant, Mr. C. A.jL. Treadwoll declared that his client was quite willing to support the children, provided they were handed over into his charge. So long as he was given custody, there would be no question of maintenance or of further action in the Upper Court.

The Magistrate was of the opinion that the case was certainly, one for the Supreme Court. He refused to make a direction to either party, and dismissed the application.
