.ACTION FOR DAMAGES FOLLOWS,

Following on an accident in Lambton quay on 3rd January last, Foster Brown, junior, took action in the Supreme Court to-day to recover damages amounting to £989 Is from James JSixon, a taxi driver,, of Wellington. The accident was due to a collision between a motor-cycle, driven by the plaintiff, and a motor-car, in charge of the defendant, at the intersection of Lambton quay and Woodward street.

Mr. Justice Salmond presided, and there was a jury of twelve. The plaintiff was represented by Mr. C. W. Neilsen, and Mr. H. F. O'Leary appeared for the defendant.

It was alleged in the statement of claim that the defendant negligently and carelessly drove his motor-car into the motor-cycle driven, by plaintiff, the collision causing Brown to receive a severe fracture of the right leg, cuts and bruises to his face and body, and severe shock which had seriously impaired his health. The injuries received had prevented Brown from following his occupation from January to the present time, and he had had to meet heavy medical and hospital expenses. As particular nad general damages he claimed the total sum of £989 Is.

The defence was a, complete denial of the various allegations made by .the plaintiff. It was further alleged that the plaintiff had been negligent in riding his motor-cycle at an excessive speed, failing to keep a proper lookout, and carrying a passenger on a seat at the back of his cycle.
