BREACH OF GAMING ACT

AUCKLAND, This Day.
I 'At the Police Court, R. A. Cleland, manager of the National Picture Theatre, was charged with a breach of the Gaming Act in disposing of money gifts of from £20 to £1 to those picking twelve men with certificates and saying: • 'Do you bear a certificate for the Count of Monte Cristo?" thai being the title of a motion picture on exhibition at the National Theatre. Mr. Poynton, S.M., said that he thought the scheme 'as carried out was a violation of section 39, but as the case was a novel one, ■and accused believed he was observing the law, after getting legal advice, it was not one for a penalty. If, however, accused desired to take the case further, he woudl be fined £5 Is, to enable him to appeal on the facts as >yell as on the law. :
