SOLER v. THE PUBLIC TRUSTEE.
In tho Supreme Court to-day, before his Honour Mr. Justice Chapman, the case Soler v. the Public Trustee, which has been before the Court on a number ot previous occasions, was again mentioned. The position, briefly, was stated to bo as follows:—The two Soler brothers were in a farming partnership. In 1920, R. L. F. Soler was committed to the asylum at Porirua, and his brother carried on the farming business. Last year the mental patient, by Mr. Jellicoe, commenced an action against the Public Trustee, and against his brother, alleging that the Public Trustee and his brother had entered into a scheme to deprive him of his property and to act adversely to his interests.
Sir John Findlay (with him Mr. Dunn) appeared for the patient brother, and abandoned the allegations. The farming partnership expired by effiuxion of time on Ist January, 1923, and his brother who has been carrying on the business now moved the Court to wind up the partnership under the supervision of the Court. An order was applied for to that effect. Mr. M. L. Myers, K.C., with him Mr. C. G. Rose, appeared for the Public Trustee; and- Mr. J. F. B. Stevensou for' F. J. Soler. (Proceeding.)
