Burnard (Gisborne), instructed by Messrs. Marshall, Hutton, and Izard, of Wanganui, for the plaintiff, and Air. ,C. P. Skerlett, K.C., ior, the defendant company.
: ■ Tho action was commenced in. Wanganni on. 11th February, the plaintiff Claiming £800 damages from the defendants for alleged breach of duty on the' part of tho company in ,regard to,the Sale of a mob of bullocks in having introduced tof the plaintiff a purchaser who was unable to complete the deal. 'Jhese issues were "placets before tike jury, the answers to those issues being to the- effect that there was-.a general custom under which* the ~ agent "was liable for the completion of the con-tract,-that there'was a custom- that the Sgent wrould . introduce .only purchasers of proved financial ability, and that delivery of the bullocks had been given the purchaser with the approval of the defendant company. , ■The question of damages did not go before the Wanganui jury, for counsel agreed that the finding upon that point should be left with his Honour following further argument at the Wellington Court as to the effect and rne soundness of the findings of: the jury and the general question of damages* This morning Mr. Burnard formally, moved for judgment upon the findings of the jury, to which Mr Skerret't relied .\yith », ; formal.. application for a non-suit.;'., •';!! ;' ';;•■ vj •" .;.: ;' .
