Many are the old stock phrases which are sought out and brushed up to a semblance of newness—to the newcomer —by counsel for the defence for the purposes of addresses to the jury, and none more often than "Those of you who have had the privilege of serving upon a jury previously." This morning Mr. Justice Reed remarked that maybe Members of the jury would not not agree with counsel as to the "privilege." Said counsel for the defence: i"Nevertheless, it is a privilege which Englishmen have enjoyed for five or six centuries." "Yes," answered his Honour, "they have—in the abstract." The jurymen smiled, but whether at the enjoyment in the abstract or in the very material, for the jury seats are hard, they did not say.
