ONGAROTO MURDER CASE

HAMILTON, This Day., After the Ongaroto murder trial the Crown Solicitor applied for n. new trial. Mr. Hampson, for prisoner, opposed the application. He said the prisoner had been in custody for four months suffering from the mental strain of two trials, and the strain of a third trial would be too great to be contemplated The evidence was purely circumstantial, and upon it two careful, /intelligent, and unbiassed juries had disagreed. Counsel contended that a fail' trial could not be expected either in Hamilton or in Auckland, where people all read the press reports and the •Judge's summing up.
His Honour said he should grant a third trial, and the Solicitor-General would declar*' whether it was advisable to proceed.
