POLICY MONEYS
Mr. Justice Hosking gave judgment to-day in proceedings between Mrs. Kirton and Messrs. Bloomfield and Simpson with, reference to the disposal of policy moneys payable in respect of a policy on the life of George Kirton, deceased. The matter had been argued in December, and the dispute was as to whether Mrs. Kirton or the other parties who represented the mortgagees of Kirton were entitled to the proceeds oi the policy. In the result, his Honour determined that the. mortgagees wea'e legal assignees of the policy moneys, but that as between them and Mrs. Kirton they were entitled eojy to a sum of £190, with the addition of some premiums paid by them, Mrs. Kirton beinc; entitled to a sum of £501 14s, the balance of the money paid into Court. The question of the liability of the fund to payment of interest on the amount due to tbe mortgagees was reserved for further argument. Mr. C. H. Tread well appeared for Mrs. Kirton, and Mr. C. P. Skerrett, K.C., with him Mr. M. J. Crombie, for the mortgagees.
