NO JURISDICTION
THE CHARGE AGAINST A CHINESE AT NAPIER. (II TBLEOP.APH.—TRESS ASSOCIATION.) NAPIER, sth December. At the Napier Magistrate's Court on Tuesday last,, a Napier Chinaman, named Yen Kee, was fined £25 for selling oranges at 6d each. At the Court this morning the Magistrate, Mr. R. W. Dyer, brought the case up again, and stated that he had been perusing the Act, and he had come to the conclusion that there was nothing in the Act giving him jurisdiction'to deal with such cases. Senior-Sergeant Eales'agreed that the Act ",was very vague and misleading. Mr: Gleeson, who appeared for the defendant, pointed out that if the case went to the Supreme Court the only thing he could do was to enter a plea of guilty. , The Magistrate then struck out the ca6e for want of jurisdiction.
