KARORI CEMETERY
AN INTERESTING POINT.
Sitting in Banco yesterday, His Honour Mr Justice Chapman heard argument in a case brought by the Karori Borough Council against <the Wellington City Council regarding the Karori Cemetery. The facts were these: In 1890 the City Council acquired land at Karori for the purposes of,, a cemetery. The land then formed part of the Hutt County. In 1891 the Karori Borough was constitutes, and the cemetery became included within the boundaries oi" the borough. Recently the City Council has acquired some 28 to 32 acres of land, adjoining the cemetery for cemetery purposes, and beUjg within the borough boundaries. The Karori Borough Council asked for an injunction to resttain the City Council from using it for such a purpose, on tho -ground that under, the- Cemeteries Act no cemetery shall be established within ihe boundaries of a borough or town district . The City Conheil, on the other hand, '^contended that "what was -proposed .was not the "establishment" Kit- the "extension" of the cemetery, and that there was nothing in the Act to prevent the recently-acquired land being used for such a purpose. Air. A. <!e B. Brandon appeared foi the Karori Borough Council and the City Solicitor (Mr J. O'Shea) for the City Council.., £ r' tho course of his remarks, Mr O Shea said there was no danger from tho sariiUu-y point of view. The difficulty was tiiHt if file land could be used as a cemetery it would not be subject to Karori Bgrough rates: Ifxthe land was not used "or the purpose the City Council would have to establish another cemetery under a totally independent administration some distance from Wellington. For tho Karori Borough- Council, Mr Brandon contended *hat the new cenW tery was "established" by the publication of the dedication of the land for cemetery purposes. " His Honour reserved judgment. .
