A RENT DISPUTE
INTERESTING CIVIL ACTION,
A civil action having somewhat uncommon features was heard in the Magistrate's Court to-day, before Mr. W. G. Riddell, S.M. Mary Fabian, of 129 a, Tinakori-road, claimed from Mario Luci Grant, of Wnterloo-avenue, possession of a house, an>' also the sum of £18 12s, alleged to bt Ine for rent. The claim was later rei.iced to £10 6s 3d. It was shown by the plaintiff that the defendant was a weekly tenant at a rental of 30s per week. On 23rd June defendant was notified that the rental would be raised to £1 17s 6d, but defendant refused to pay the additional rent, and also declined to quit the premises. The facts placed before the Court showed that the property had been valued by the Government valuer at £1080, while a competent valuer had assessed the value at £1187. The owner's valuation was £1450, but the Magistrate considered this exorbitant. He fixed the value at about £1100 and the rental at £1 14s per week. Judgment was given on this computation for £5 10s, with, costs.
Mr. T. H. Gill appeared for the plaintiff and Mr. C. W. Tanner for the defendant.
