HON. R. PHARAZYN'S WILL

Matters "relating to the will of the late Robert Pharazyn, of Wellington, came before the Court of Appeal this morning. The case arose out of an originating summons in which Godfrey Norris Pharazyn was the. plaintiff, and Charles Hayward Izard and Edwin George Jellicoe were the defendants, and it had been removed into the Court of Appeal for argument. The Bench was occupied by their Honours the Chief Justice (Sir Robert Stout), Mr. Justice Edwards, and Mr. Justice Chapman. Mr. M. Myers appeared for the plaintiff, and Mr. E. G. Jellicoe for the trustees and Mrs. Pharazyn. In support of the originating summons, 'Godfrey Norris Pharazyn, of Eastella, near Hastings, a nephew of the testator, said that the properties -referred to in the will as Marahou and Tewkesbury had been sold since the death of the testator for the sum of £60,000, of which £49,790 is secured upon mortgage. He was desirous of raising money upon the security of the interest, as', in the terms of the will, he was entitled to the properties or the proceeds of the sal& thereof, but Ke -was unable to obtain advances until certain questions had been decided defining his legal position as a legatee. Decision was reserved. „

Chinese, according to a statement made at the Conciliation Council to-day, are leaving the grocery trade. Two Chinese only were cited as employing - parties to the grocers' dispute, and the union secretary (Mr. J. M'Kenzie) stated that these were the only ones remaining in the trade. The others who had been parties to a previous award had left the dry-goods business shortly after the Saturday half-holiday came into operation, as if they had not done so they would have been compelled to close their fruit and vegetable shops at 1 o'clock on Saturday. Now, some of them sold cigarettes, tobacco, sweets, and biscuits, but no other lines outside fruit and vegetables. Pte. R. W. Cooper, of the Head Office, Lands and Survey Department, who left with the Fifth Reinforcements after serving in Samoa, was reported missing on the Bth August. His friends and fellow students at Victoria College will be pleased to know that post-cards received in Wellington on Saturday last indicate that he was quite well on -the 12th August. Mr. P.
