Judgment was given by his Honour the Chief Justice this morning in the case in which preliminary law points were argued before Wm in an action between Richardson, M'Cabe, and Co., Ltd., plaintiffs, . and the City Corporation, concerning a contract entered into by the plaintiff for the supply, of mo tor- buses, to the Corporation, and for damages for refusal to accept such 'buses. The points of law raised included the question whether the acceptance by the Corporation of plaintiffs' tender" was a contract. The question of misrepresentation by the company was also raised, and it was argued that the Corporation repudiated the contract because of such misrepresentation- His Honour held that there had been a contract, that at present he saw nothing in, the' statement of facts to show that the Corporation -was induced to give the price agreed upon by the statements made by the tenderers, and if the repudiation was based < only on a misstatement as to the prices, that would not. entitle the Corporation to repudiate the contract. Miss M'Lean, who went away a.s matron in • charge of the nurses on the Hospital Ship Maheno, arrived bqck in Melbourne on Tuesday on an Australian transport, .and is expected to return to Wellington' in a fortnight's time. Members of the Retail Drapers' Assistants' Union have decided to inauguiate a Sickness and Benefit Fund.
