INDECENT PUBLICATION
.In giving judgment in the Winning Post cases yesterday, Mr. D G. A. G'doper, S.M., stated as on© of the reasons for not inflicting a heavy penalty that defendants did not know tho periodicals were of an indecent nature. They had not road the book through, nnd they did not know that they were selling anything indecent. It had been submitted by counsel that, because the books were pasted by the Customs authorities it was reasonable to expect that they were fit for 3alc. However, it was the duty of all new a vendors to ascertain for themselves whether there was anything indecent, immoral, or obscene ir any books, newspapers, or periodicals sold by them. In tho cases which had been before him, the name of Ihe book should have acted somewhat us a. warning, for it waa precisely similar to a newspaper noted > for a certain class of paragraphs and limericks. However, he understood that the cases were brought only ns a warning that in future the book must not b© sold, no the penalty would be light.
