PURCHASE OF AERATED WATERS
1» At the Supreme Court yesterday his Honour Mr. Justice Hoslung delivered judgment in the action Alfred M. Lewis, of Thomson, Lewis, and Co., aerated water manufacturers, Wellington (plain' tiff) ' and Horace Ernest Somerville, licensee of the Albion Hotel, Wanganui (defendant), a motion for an injunction to restrain the latter from committing a breach of contract. _ The plaintitt' claimed that defendant, in consideration of being advanced J350 at 7 per cent interest, undertook to purchase aerated \vaters from plaintiff's firm for a period of twelve months.. The defence was that the agreement was unreasonable and im restraint of trade; further, that defendant had offered to pa.y the sum back. v His Honour dismissed the motion for an interrogatory injunction, with costs (£8 8s), and disbursements to be costs in the cause. At the hearing Mr. C. B. Morison, X.C, appeared for the plaintiff and Mr. T. Young for the defendant.
