STAR OF CANADA LITIGATION
Salvage matters in connection with the loss of the Tyser line eteamer Star of Canada were mentioned in Chambers yesterday before Mr. Justice Chapman. The question was whether proceedings by J. J. Niyen and Co., of Napier, engineers, against the Tyser Company over the valuation of the material salvaged, and the cost of salvaging, should be postponed from the sittings of the Court at Napier next week in order that the evidence of Captain Taylor, who was concerned with the salvage operations and who is at present on his way from England to Australia, might bo obtained. On behalf of the defendants, Mr. C. P. Skerrett, K.C., urged the importance of Captain Taylor's evidence; it would be unreasonable to proceed without it. Sir John Findlay, for the plaintiffs, submitted that Captain Taylor's evidence was immaterial, as h? had, before his" departure from New Zealand, referred parties to the representatives of the defendant company at Napier for information connected with his position in the salvage operations. His Honour held that Captain Taylor was an important witness, and his evidence wae distinctly material to the case. He had been connected with the matter right through. His Honour made an order postponing the trial of the case until the June sittings of the Supreme Court at Napier.
