ALLEGED BETTING

'"Paddy" Le Sour and Harry Wales appeared before Mr W. G. Riddell, S.M., at the Magistrate's Court yesterday to answer to a charge of betting on licensed premises, the New Zealande* and Duke of Edinburgh Hotels. Mr. E. J. Fitzgibbon appeared for the , defendants, and Sub-inspector Sheehan conducted the case for the police. . t , Constable Smyth gave evidence as to his making bets with defendants in the New Zealander and Duke of Edinburgh Hotels. He went disguised as a baker ; as a matter of fact he had been a baker in Oamaru before he joined the police. He took a double with Wales on Patriotic and The Rover, and also booked a single bet with him. Detec-tive-Sergeant Casseljs, whom he met afterwards, marked a half-^rown for him, ajid |with this coin he (witness) made a bet with Le Seur in the New Zealander Hotel. . Cassells subsequently arrested Le Seur on warrant, and searched him ill a. private room. The marked half-crown was found amongst the money taken from his pockets. On the way down to the station, Le Seur said to him, " I thought you were a *-• — baker." In his defence, Mr. Fitzgibbon submilted that evidence must be adduced to prove every element of the offence i which ff an offence created by the Gaming Amendment Act, 1910. In the first place the man must be a bookmaker; secondly, he must make a bet; and, thirdly* he must make that bet on licensed premises. The clause ift the Act refers to bookmakers, and it must be first proved that the defendants are such. None of the witnesses could prove that the i»en were bookmakers.
