FIVE HOURS' BATTLE.

On the 3rd instant, Joseph Shaw boarded the 8.6 p.m. car from Government station to Miramar in a very intoxicated condition. When the car approached Moxham-avenue the conductor called for fares, and, without any provocation or reason (according to the police), Shaw struck the official a savage blow over the face. At the moment the car was travelling at a fair pace, and it was a miracle that the conductor was not knocked on to the road. The car was stopped, and Shaw at first refused to get off, but ultimately alighted. As he was staggering away from the car, however, he called out a filthy expression to the conductor, within easy hearing of a car full of men, women, and children. Passengers were prepared tv testify that the epithets were the most obscene they had ever heard. At the Magistrate's Court this morning, before Mt. W. G. Riddell, S.M., defendant Shaw, a man of respectable appear- I ance, admitted allegations of having used bad language and assaulted Frederick James M'Dougall. On behalf of accused, Mr. F. Kelly stated that the man was of usually good character, and his offences were due solely to drink. Shaw was under the impression that the conductor had made a reference to his (Shaw's) previous conviction (when he was fined for throwing a missile at a car), and that the conductor had pointed him out to another man. His Worship remarked that both offences were quite unwarranted, and told the man that if liquor had that effect on him he had better leave it alone. On the charge of using obscene language Shaw was fined £4, default being twenty-one days' detention ; for the assault, a penalty of £2, with one witness's expenses (6s), wa-s imposed, his option being fourteen days in gaol. Shaw having suggested that a prohibition order be issued against him, this course will be adopted. Sub-Inspector Norwood stated that defendant had previously been fined £10 for assaulting the police, with a two-months' option ; he had also been punished for previous use of obscene language.
