Evidence was given by Inspector Seed that on Sunday, the 16th December, he stopped defendant's cart in Courtenay-plaoe to examine the boxes in which the poultry was being carried. He found seventeen largo fowls in a box 2ft 3in long, 22in wide, and 13£ in deep. They could^ not stand up, and were in a state of suffocation; one to be nearly dead. The- ducks were crowded in two kerosene cases, 19£ in long. Win deep, and lOin wide. At least twice as many birds were in each case as there should have been for air-spacet alone. The poultry was being brought into town irom a place near Tawa Flat. Defendant said that the birds were in the cases only for an hour and a half; the ducks were very small, while the fowls were not large , he merely put them into the box until they could be freed at the larger coops in town. He did not generally tieat poultry like that, however. Efe admitted that it was a very hot day. Mexted was convicted and fined £2, with court costs 9s, in default ordered to undergo- forty-eight hours' detention. Mr. WeTDb appeared for the S.P.CA.
