CIVIL JURISDICTION. COMMISSION AWARDED.

Reserved judgment was given by Dr. ll'Arthur, JS.M., in the civil action brought by Warburton and Co., land and estate agents, of Wellington, against John George Falder. land agent, of Wellington, to recover the sum of £32 10s, commission, at 2g per cent., upon a sale of land and premises of the defendant at Hall-street, Wellington South, the price being £1300. In the alternative, plaintiffs claimed the £32 10s as " fair and reasonable remuneration" for services rendered. .;t was shown, that the defendant had mlde two, if not three, reductions from, the original price of £1950. Plaintiffs sold at £1300, but defendant refused to complete the ptrrchase, as he said the sum referred only to the house ho occupied, and not to the remainder of the property. The magistrate noted, however, that at no time did defendant inform the plaintiffs that he had sub-divided the property. If there had been a mistake, defendant, in his Worship's opinion, was entirely responsible, and hence the plaintiffs must not be deprived of the fruits of their labour. Judgment was accordingly -entered for the plaintiffs for £20 — as a quantum meruit for their work done — together with usual costs. Mr. M. Myers appeared for the plaintiffs and Mr. E. Hadfield for defendant. JUDGMENT BY DEFAULT.
