DISPUTED WEIGHT OF COAL.

At the Magistrate's Court to-day, before Dr. A. M' Arthur, S.M, Samuel Brown, Ltd., coal -merchant, of Wellington, claimed £57 18s 3d from the Tyneside Proprietary Coal Mining Company, Ltd., as balance alleged to be due on an account for coal supplied. The particular shipment was unscreened Stockton coal, brought from West port by the Rakanoa in December, 1909. The whole dispute was about the weight of the coal delivered, plaintiffs contending that it was slightly more than a ton (by baskets}* and defendants that it was somewhat less. Mr. A. L. It was shown that a compromise between the parties had settled upon 5.2 baskets to the ton, but defendants contended that, whatever may have been the weight of Stockton coal as a rule, the weight of this particular shipment was 3741b to the basket — or about six baskets to the ton. Moreover, ( the plaintiff company was estopped by" its receipt (produced) and conduct from making the present claim. | The case was not concluded when The j Post went to press.
