FIVE THOUSAND POUNDS DAMAGES.
VARAWA v. HOWARD SMITH COMPANY. By Teleerash. — Press Association.— Copyright. MELBOURNE, 31st May. Varawa has been awarded £5000 damages and costs against the Howard Smith Company. The judge held that defendants' action against plaintiff was not justified. [Peter Fedorovitch is a Russian. On 21st January, 1905, following negotiations for the sale of the steamer Peregrine (wnich it was understood was •wanted for Russia, then at war wipli Japan), the defendant company instituted proceedings against Varawa for breach of agreement, and he was arreited when leaving New South Wales, and held in Darlinghurst Gaol on a wriu of capias for eleven days till security for £4000 was forthcoming. On this arrest the present action was biought. The defendants denied liability, or that Varawa had any cause of action. Varawa chimed £20,000. The case was heard before Mr. Justice A'Beckett and a jury of twelve.]
