A CLAIM FOR OTMISSIGN. NOT ALLOWED.
Dr. M'Arthur S.M., at the Magistrate's Court this morning delivered judgment in tho case of the Johnsonville Co-operative Building Society v. Schlaik. Plaintiff claimed the sum of £5, being commission on the "gale of a:n appropriation of £500 in the plaintiff society, mado on behalf and at the request of the defendant. The appropriation was drawn in October, 1906. The secretary of the socjety had verbal authority from Mrs. Schlaik to accept and sell on her behalf should the appropriation be drawn by her number. No written nuthority to soil had been given. The court' held that the sale was not effected i>y the society or its secretary. The sale ,v/as withdrawn on the day following the drawing. Judgment was given for defendant with costs,. Mr. Toogood appeared for plaintiff, and Mr. Hindmarsh for defendant.
