[BT TELEGBAPH. — PRES9 ASSOCIATION.] PAHIATUA, This Day At a sitting of the court before Mr. James, S.M., Herbert Vile sought to recover from James Donaldson the amount of the dividend paid by Lomaria — less one pound returned — at the lecent Ashhurst races, and which horse plaintiff instructed defendant to back. Plaintiff was nonsuited, the. Magistrate remarking that, notwithstanding that the totahsator was a legalised form of gambling, no money staked or lost could be recovered in a court of justice.
