Lambing has commenced in the Poverty Bay district. j This afternooD the Court of Appeal began hearing of the appeal of Cowlishaw and another v. the Christchurch Press Company. Mr. Bell, with him Mr. Sflringer, appears for tho appellants^ Mr. Hosking is counsel for the defendantxjompany, and Mr. Acland for Robert Heat on Rhodes. The Bench consisted of the Chief Justice, and Justices Edwards, Cooper, and Chapman. The case was before the court at a previous sitting, when an adjournment was made to permit of full representation of affected parties being secured. Mr. Rhodes comes into the case as figurehead for the holders of preference shares in the company, and thus there are now 'represented before the court the company itself, the ordinary shareholders, and the. preference .(shareholders. There is nothing- of great public interest! concerned in the case, the chief point at issue being the manner in which certain profits of the . company 'should be applied, i.e., -whether certain surplus moneys have lost their character of accumulated profits and' become assets of the oompa-ny not distributable in dividends. It is said that these moneys were used to build up the bujsineys of tlfe company, and; the court is moved to say whether this was correctly done or whether the moneys should have been paid in dividends. As a matter of fact, the moneys have been largely applied to purchase of machinery and improvement of buildings. Argument as proceeding. It is probable that the Anglican authorities will shortly consider the question, of making a forward movement with regard to the contemplated construction of a cathedral in Wellington.
