An aotion of a rather singular nature camo boforo his Honour the Chief Justice this morning, when the Wellington and Manawatu Railway Company was proceeded against by ono Madigun, the lessee of tho tollgato at Kaiwarra, who sought to recover the sum of aa damages, for alleged loss sustained by him through tho acts of the Company's employe's. Iho declaration of the plaintiff setforth that, owing to tho operations carried on on tho hillside by tho contractors, tha road on which was situated the tollgato was rendered dangerous to passers-by, and a great deal of vehicle traffic was consequently lost, the rosult being a decrease in the amount of revenue which he derived from tho tollgate. Mr. FitzGerald was for tho plaintiff and Mr. Travera for the defendants. After a considerable amount of argument, a cose was stated as to whether tho company was liable for the acts of its contractors.
