SUPREME COURT.
? CIVIL SITTINGS. ' THIS DAY. (Before his Honor the Chief Justice and a Special Jury.) BISHOP V. MACDONALD. The following gentlemen were sworn as a special jury : — Messrs. J. M. Taylor (foreman), A. Warburton, C. Bonnington. E. H. Crease, W. C. Chstfield, A. Boardman, J. L. Moffit, A. Reid, ti. Rose, J. A. Allan, Q. H. Luxford, and J. Moore. Mr. Ollivier appeared for the plaintiff, and Mr. Travers with Mr. Edwards for the defendant. The plaintiff, Robert Bishop, is a commercial traveller, who was formerly in business as a storekeeper at the Hutt, and tbe defendant is Mr T. K. Macdonald, the action being brought against him in his capacity of creditors' trustee in the bankrupt estate of Alfred Maclean, cabinetmaker. Bishop was in the employ of Maclean, and managed a branch store at the Hutt. He alleged that he finally bought this branch from Maclean. Shortly after Maclean was declared bankrupt, and Mr. Macdonald was appointed trustee. Having reason to believe that Maclean was privately disposing of his goods, Mr. Macdonald seized them on behalf of the creditors. Among the goods seized were some which were alleged to belong to Bishop, and he now brought an action to recover £350, the value of the goods so sold. Mr. Travers obtained leave, after argument, to amend his pleas. In reply to his Honor, Mr. Ollivier said he was afraid that, with the amended pleas, the case would last at least two days. As this would interfere with the other cases down for trial, it wqs agreed to postpone the case until next sesssion of the Court, and the jury were accordingly discharged.
