MAGISTRATE'S COURT

SITTING AT UEESTON

A sitting of the Magistrate's Court was held at Leeston today, Mr H. A. Young, 5.M.,, presiding.

The Transport Department applied for the withdrawal of a-case against W. J. Montgomery, which was partly heard some months ago. This was granted.

Claim for Possession There was a claim for possession of a house, which was defended by the tenant. The plaintiff was Mrs E. Gluestein and the defendant, WY P. Sutherland. Mr Reed appeared for the plaintiff and Mr Lyons for the defendant.

Mrs Elizabeth Gluestein, living at Greenpark, said that defendant was renting a house property at Leeston from her. She wanted the house for her own use and had legal notice served on him to quit. She had obtained an offer of an accommodation for the defendant in a furnished house and had also offered to store his furniture. This was refused. Plaintiff had also made enquiries and had told defendant where houses were available in the district around Leeston.

To Mr Lyons: There was another, house on her property, but it Was condemned and would have to be pulled down. She would not let it because it was not fit to livfe hi. She understood that the defendant's employers were negotiating for the purchase of a house property in Leeston. s The defendant said that since receiving notice he had been trying to obtain another (house but without success. If the firm purchased a house in Leeston certain alterations would be necessary before ha could move. He was a married man with three children and his parents were also living with him. The house- offered to him was hot suitable, nor were the contfitiohs of the tenancy satisfactory to him. In his wdrk.it was desirable for him in his business to live in Leeston.

The case was adjourned for a month in order to await results, of the negotiations for the purchase of a house by the company.
