Magistrates £Oourt Opliir, June 17th

Walter Haig (Mr Bodkin) v Joseph Bretton Harrison (Mr Harlow) claim £l7 11 10 for goods supplied and money lent. . The items in the statement of claim were, Groceries £ll 4 10 money lent £1 8 0, money paid at defendant’s request £ll 12 0, interest £l 8, less payments on account £7 18. The defence alleged that defendant had worked for plaintiff for 31 days at 12s per day and had not been credited. Of this only £7 17 0 had been credited. Plaintiff denied the agreement to work at 12s per day and stated that he had engaged plaintiff at 2s per hour, and had paid him for the time worked The money lent (£ll 12s) had been advanced on the security of Harrison’s wife’s jewellery Haig did not wian to accept security but offered it back. Defendant had however insisted on it being retained until the balance had been paid. Defendant in evidence statsd that he had not asked Haig for wages before leaving Lauder as he was still dealing with him.

Mr Bodkin contended that the claim for wages could not be taken in this action, and after hearing argument and discussion the Magistrate gave judgfor the amount claimed (less £lB 0 charged for interest) with costs. The Magistrate intimated that if Harrison were to bring, a claim for wages, he would accept the evidence given in this case to save Harrison the journey from Kurow. Mr Bodkin offered no objection.

M. J. Hargrave v C. Lawson ckim £3 for board and lodgings. Defendant appeared and stated that he laid paid the account, but did not have a receipt. —Judgment was given for the amount claimed, with costs. M. J. Hargrave v D. Hussey, claim £4 for board and lodgings —Judgment was given by default, with costs. For exposing lousy -sheep for sale at the Oturehua stock sale, two farmers were fined Jos and 20s.

J. Kitto, for cruelty to a horse, was fined £2 with costs 10s. The evidence showed that accused had been riding a horse which had open sores on its back.

At the Alexandra Court on Thursday, J. Gladstone was lined £2 for driving a motor car at an excessive speed, aud for riding a bicycle without a light Clement Kitto was fined 10s.

The Court was occupied all day Wednesday hearing an {affiliation case, which was adjourned.
