R.M. COURT, CLYDE.
(Before J. N, Wood. Jfoq. R M.) ROBERT ROBERTSON V. C. T. MARIE. This was an action for assault, in which R. Robertson claimed to liaye defendant Marie bound over to keep the peace. Mr Gilkison. who appeared for informant, stated that their proceedings wore taken only for the sake of peace, and we e made necessary by an assault which took place on July 2fl. On that date Robertson was (hiving a coal dray clown Dairy Creek dully —a lonely spot-about four miles from Clyde—when a stone landed on one of his horses, Robertson looked up, and saw Marie standing on a rock above him. and as be looked was stiuck on the head by another stone from defendant. Robertson fell senseless, but fortunately the horses stood still, and when he came to himself he was lying under the On going to Marie’s house, defendant said he would do the same again, and pointed a 1 revolver at Robertson. The assault was seen by no one hut Robertson ; but several persons saw him soon afterwards with his head badly cut, as if by a stone. Evidence in support of the opening statement was given by R. Robertson, W. Uren, and Sergeant M’Leod.
Defendant, on being sworn, denied all knowledge of the affair. He said that he had only seen Robertson that day from his window, and knew nothing of the alleged assault. Ho gave' a Ibng account of. his grievances since the year 1888, and complained bitterly of his treatment by Robertson.
The Resident Magistrate said that in this case each party made statements and denied all the statements made by the other. He would only bind over Marie to keep the peace if Robertson also were bound. Order made (by consent of R. Robertson) that each party enter int)| 'recognisances to keep the peace in a penally of L2O. ' I - I ;
