APPEAL UPHELD.

Wellington, ThL day. Judgment was given in the Supreme Court this morning iv the case in which the Hastings Borough Council appealed against the award of damages given against it in respect of flood water from a Corporation drain invading the hop gardens of Mr Masters. The Court upheld the appeal, being of opinion that the Corporation had not been guilty of negligence, and that tho respondent's land had benefited rather than otherwise Costs were given against the respondent Masters both on the appeal and ac to the proceedings in the Court below. An application by fllr Js,'d wards, on behalf of the respondent, for leave to appeal was refused.
