THIS DAY. JkEX JAMES at, JIUNN. Mr. Loo appeared for tie bankrupt. Discharge gniniod. BE E. AY. BLACKWELL. Mr. Oresswell aijpeuied for the bankrupt. Mr. Lascelles, on behalf of Mr. J. V_ Brown, opposed the discharge. His Honor said books should have been kept. No. immediate discharge could be granted when such accounts had not been kenfc.

Vir. Cresswell objected to Mr. Lascelles being heard, as Mr. Brown was not a creditor.

His Honor decided to hear Mr. Lascelles. Mr. Lascfcilea said Mr. Brown held a powec of attorney for the largest creditor in the estate. It was quite sufficient for opposing the diecharge that the bankrupt had not keot books.

Mr Sainsburv appeared for the kssignev. It was a claim for £70 13s 10d and interest against Kerr and Co. The payment, they alleged, was a preferential one.

Paul A. F. Birch produced the record; book containing the judgment in the case* of Kerr and Co. v. J. G. Kinross. He alao< produced a declaration of insolvency by J. G. Kinross.

J. K. Goudy deposed he remembered fti e writ being served by Kerr and Cα. on J. G. Kinross.
