Tho case of Dawson v. the Queen, which was commenced in the Court of Appeal on Friday,was concluded yesterday afternoon. The appeal was against the decision of Mr Justice Williams in granting a new trial. The appellant was the owner of a sawmill that was burnt down in Invercargill in March last. An action was brought by him against tho Queen for the value of the property destroyed, as it was alleged that a spark from a railway engine had set fire to the mill. Tho jury returned a verdict for £1650. A new trial was subsequently granted by Mr Justice Williams on tho ground that Dawson had not proved that the railway officials had been guilty of any negligence, and it was against this order that Dawson now appealed. Their honors sustained the appeal, holding that a new trial was not required.
