THURSDAY, SEPTEMBER 1. (Before His Honor Judge Kenny.) TURLEY V. THE TaRADAXE BIVER C0_?« SERVATOKS. Mr Lascelles, who appeared on behalf of the plaintiff, applied that the case might be adjourned until the next Court day. He said he did this at the request of defendant's counsel, who had not yet filed a defence, and had expressed willingness to bear the costs of the adjournment. The adjournment was granted, costs of adjournment to be paid by defendants, and pleas to be filed by Monday next, by 4 p.m. ATHEBTON V. DAVIS. This was a claim tor £90 for professional services as surveyor, &c. Mr Lee appeared for the plaintiff, and Mr Lascelles for the defence. Mr Lee took objection to the defence filed as not being sufficiently explicit. His Honor said that the first plea of not indebted was good so far, but meagre, and he thought that if defendant's case went on under the present pleas it would be under a disadvantage; they would limit the evidence on his behalf to a very considerable exteot. Mr Lascelles contended that the plea of not indebted was sufficient. He held that if separate pleas were to be put in to each item the defence filed would contain the evidence in the case. However, as the Court appeared to be against him, he would ask leave to amend his pleas. After a lengthened argument between counsel, His Honor agreed to adjourn the Court until noon, to enable Mr Lascelles to put in a fuller statement of defence. At noon Mr Lascelles put in his amended pleas, upon the inspection of which Mr Lee stated that it so altered the aspect of the case that he was unable to go on with it. He therefore applied for an adjournment, which was granted to the 15tb.
