WARDEN'S COURT, THAMES. [Before G. B. Davy, Esq., Warden.]

Erskine and Othebs v. C. J._ Stone. — This case arose out of a certain action on the part of defendant or his attorneys in marking out the ground formerly occupied by the Thrieve Castle Company, and applying for a lease of it, the said ground haviug been, according bo the showing of the complainants, taken up by them under miners' rights prior to the occupation of the defendant Stone. This case was heard before the following assessors :— Messrs. Harris, Renshaw, Allan, and Henderson.— Mr. Beveridge and Mr. Miller appeared for the complainants, and Mr. Macdonald for the defendant.— After hearing the evidence of the chief clerk of the Warden's Office ; the chief clerk of the Registrar's Department, H. P. Jones, who had given instructions to peg the ground out; and Alexander Erskine, the agent ; it was adjudged that the plaintiffs were in prior occupation, and therefore entitled to the ground.
