RAGLAN R.M. COURT. NOVEMBER 22. [Before W. N. Searancke, Esq., R.M.]
Vause v. Kewene.— Claim, £G 18s. Bd., for goods supplied. — Judgment confessed. McCra.ckex v. Gaoe.— -Plaintiff sued for £5 10s., the value of a heifer which defendant had appropriated. The animal was left in plaintiffs charge. On the Ist instant he saw the heifer in defendant's possession. He described the beast, and nwore to it as the one lefb in his care by lug brother,— Two witnesses were examined, who swora posi« iively to the beast, and a third expressed his full belief to the same effeet.—Defendanfc stated that ha purchased cattle from Mr. JSuckland in 1864, which cattle were running at Karioi mountain, and he consequently claimed all unbranded cattle running there. He caught the beast on the 9th ultimo. It was very wild. He saw her first among his cattle in September, 1869. He had caught cattle there for six years, and had had no previous dispute. The heifer wna now in the pound. — Three native witnesses stated their belief that the heifer was defendant's, because it was caught amongst his cattle, nn<\ because it was so wild. — Judgment for plaintiff, full amount and costs. Application foi? Execution.-— Mr. Bell applied for au execution on a judgment ho obtained for £20 (Bell v. Rinnan d) two months ago. — His Worship said he could nofc grant one, inasmuch as the defendant was, as far as is known, dead. Plaintiff must apply for hid money through tho Receiver of lui-esfcafce Estates. I may say that defendant had, and has, several head of cattle and horses on his farm at the Mata, the greater number of which, have been drircn off subsequent to the above judgment. Of course the remainder will soon follow suit, and then tho intestate estate will pay nothing. The case is especially hard, because the plaintiff has had next to nothing to depend upon except the £20. He hag been waiting with exemplary patience for two months for his money. — [Ovrcf Correspondent.]
