[Before bis Honor Judge Becjeham.] '. His Honor gave judgment in the two following cases : — | BiraxTß v. smith. Claim, £38 9s. 7d. His Honor said that in the above case the Court was of opinion that the judgment must past for the plaintiff. In doing bo, the Court felt that it had no alternative but to let the costß follow the judgment. ESTATE OP BBOOXEIELD AMD COX y. VIALOTT.' ,' Claim, £22 14s. 6d. His Honor laid that in this case judgment mutt pass for the plaintiffs. ' ' , Mr. J. B. Eussell said that Mr. Brbdkfield didaot wish his costs assessed. ' ;
