SHOOTING A COW. A case of considerable iinpottauce wan partially hoard, Malcolm v. Osborne, for the amount of £21 10a. , for damages sustained by tliq defendant's son shooting a cow belonging to the pl.vintiff. Neil Malcalm, the plaintiff, deposed : I am a settler at Kawau. Ou the 15th August last, I was possessor of several cows, ' one of which was shot on that day. Ou the afternoon of th.vt day, the defendant's son and two other men, having a dog and gun, were observed by me going out in a small boat. They weie about 100 yards distant when I observed them, and they got into the boat "and went to the spot wlieie my cows and calves were grazing. The boat was beached when I heard a gun fired, and about a minute afterwards another gun was fired. The cow was shot immediately after tho boat had beeu beached, which would bo about 4.30, but 1 took no particular notice of tho tune. At about 9 o'clock iv the evening I heard the boat go off, the senior Mr. Osmond being in it at the time. 1 went to the place where the cows wore two days af toi wards, which was near wheie tho euns had been fired. I i saw tho cow hanging up dressed, but could see neither skin n>r head anywhere about the place. I ( found out a place where the head .uid *kin had been buried close alongside, which I swear to ba mine. I told Osmond that I should put a sto;> to that to such work. Tho intrinsic value of the cow would be about £25 ; if anything might be put down at a higher figiuv.
