Auckland, 23rd July, 1853.

Sir,— Although it is true, I consented at the request of upwards of Jive hundred of the Electors to allow myself to be put in nomination as a candidate for the Supcrintendentship of the Province of Auckland, and equally true that I stood the continued annoyance and attacks consequent on a contested election ; still I doubt it it would not be more acceptable to the inhabitants at ldige were I to lesign the position I have thus acquired, in favor of some bon&Jide settler, as evidently there exists, on the irinds o f very many, a feeling of distaste against one of my profession being so employed while in the actunl service of the Crown. In point of law theie cannot be the slightest doubt, as I have already ventured to express to your Excellency, but the adusnbility, or propiiety of such a move, has been a point of much consideration, e\en to myself, from the commencement. When once put up, it would hnve laid me ooen to a cbaige of pusillanimity had I withdrawn till the point was carried, but now that I have acquitted myself in that respect, I beg to acquaint your Excellency that I am perfectly ready and willing to lesign if your Excellency is of opinion I could, by so doing, forward the interest of the PiOMnce or the Colony. As far bs lam indhidually concerned, I confess I ha\e no taste whatever for any position not immedi1 a f ely undei the Crown, and, in this instance, I see nothing befuie me but cares and anxieties.
