Government House, Auckland, November 7, 1853.

My Lord Duke, — Upon my arrival here, a few days s'nce. I found hing here for me a letter, from Lieut. Col. Wjnyard, if questing me to transmit to your Grace the pnclo^ed co}>y of a letter, which Mr. W. Brodie had addiebsed to tlie Commander-in-chief. 2. In compliance with Lieut. Colonel Wynyard's wishes, I enclose copies of his own and Mr. Brodies letter for your Grace* infoiination. as also a copy of a letter which I addiessed to Lieut. Colonel "Wynyard, when he first acquainted me that he had been requested to permit himself to be nominated as Superintendent of tins Province. 3. I already, in my previous despatch, No. 108, of the 18th October ia^t, enclosed to jour Giace a copy of Mr. W. Biodie's lettei now transmitted, and I have nothing to add to that de c patch, except to state, in reference to that portion of the enclosed letter fiom Mr. Brodie in which he states, that a poition of his complaints was to be made a subject of legal investigation lieie. that it will be found fiom the enclosed pioceedings in the Supreme Couit of this Colony, that these complaints were brought before a jury >n thai Couit, and that the jury awarded twenty shillings damages to the plaintiff in the case ; to this I should add that all hough the jury viewed the matter in so tiifling a light, I should have regaided it as a veiy wrong proceeding, if Lieut. Colonel "Wynyard had, either directly or indirectly, been the author of the newspaper paragraphs complained of, but 1 am entirely convinced that he was in no way whatev ci implicated in the matter. Colonel \\ ynyard, of a pre vious date, form which it will be found that he has tendered his resignation of the office of Superintendent, if I think it right to call on him to usign it, which, however, I do not piopose to do, as I think that the interests of the public will, for the present, be best piomoted by his continuing to hold the office.
