Resident Magistrate's Court.— July 12. Wellesley Hughes v. Monk.
This was an action to recover the sura of £6 16s. Id., under circumstances detailed in the following evidence. The plaintiff, Mr. Hughes. SaM, that lie 591 lbs. of bacon of- the defendant in May last, at 6d. per Ib. That understanding Mr. Monk had a cargo of bacon for sale, he had gone up to his place with the intention of buying the whole of it — that he saw the sides of bacon, which wei'e all lying together, — that Mr. Monk represented them as " some sound and some unsound," — that he took what he thought was sound — and 4801bs. turned out bad, and he was obliged to auction it — that it netted at auction £5 '3s. lid., the difference between which sum and that paid by him, to Mr. Monk (£l2) being the amount sought to be recovered. Mr. Hobson, from the firm of Weston & Co., auctioneers, produced the account sales of bacon sold for Mr. Hughes. " The bacon J sold was not sound — if it had been sound I could have sold it for 6ld. I sold some to Robt. Lockhead on the Bth June. That bacon I sold was unsound. When it came to me, Mr. Hughes put a limit of 6 ld. per lb. on it. I offered it for sale privately, and when I found it was bad, and would not sell so, I advised Mr. Hughes to sell it by auction for what it would fetch. Eobt. Lockhead said, the meat I bought at Mr. Weston's, I sold for Bd. a pound— none was returned ta me. I paid 4d. a pound for it. The lot I bought being a small lot, suited me — the rest was put up in larger lots, and did not fetch so much as 4d. — Williams was going down the Crescent 1 at the time of the sale at Weston's, and 'hearing there was some bacon that, was reported bad, going very, cheap, looked J in, and bought the remaining jots of it at 2Jd. per lb. Is " retailing that bacon at 6ji to sell again, and he must 1 get a profit on it." Judgment next Court day. July 13. A native, named William Martin, was charged with assaulting Mrs. Coolahan, of Shortland Crescent. The complainant stated, that the prisoner came into the shop and asked for a drink of water — she told him she had none — he insisted on having some, and attempted to go round the counter ; and on her getting in the way to prevent him, he knocked her with his hand against the wall. He was sen • fenced to pay a fine of 20s. and costs, or to be imprisoned 7 days with hard labor. Fine paid.
