ALLEGED UNLAWFUL CONVERSION
Two Brothers On Trial
CAR FOUND SMASHED AT
BOTTOM OF GULLY
Charges of unlawfully converting to their own use a ear valued at £lOO, the property of James Baxter, at Wellington on January 11, 1941, and of wilfully damaging the car to the extent of £lOO, were brought against Gordon Frederick .Miller, aged 29. motor driver, and David Hugh Miller, aged 38. clerk, in the Supreme Court, Wellingtoh, yesterday afternoon, before Air. Justice Johnston. Both accused, who pleaded not guilty, were represented by Mr. R. Hardie Boys. The Crown Prosecutor, Mr. C. H. Weston, K.C., with him Mr. W. It. Birks, conducted the prosecution.
In his opening address, Mr. Weston said that Mr. Baxter Lad left his car pahked in Frederick Street, Wellington, on the afternoon of January 11. When he went to get it late that night, it ha'd disappeared. He next saw it lying smashed to pieces at the bottom of a gully below Hornsey Road, Lyall Bay.
The trial will proceed at 10 o’clock this morning.
