KILBIRNIE STADIUM CASE
Long Hearing Ends The action brought by Wellington Speedways Ltd. against Association Football Grounds Ltd. was concluded in the Supreme Court yesterday before the Chief Justice (Sir Michael Myers). The dispute between the parties concerns the lease by plaintiff of Kilbirnie Stadium. . Mr. I*. B. Cooke, K.C., with him the Hon. W. Perry, appeared for plaintiff and Mr. D. W. Virtue, with him Mr. J. Meltzer, for defendant. Yesterday was the fourth day of the hearing. At tlie conclusion of the evidence for the defence, plaintiff called evidence in rebuttal of the Wellington City Corporation’s report on the repairs needed at the stadium. Cyril Hawthorn Mitchell, architect, Wellington, said that at least 60 per cent, of the seat-tops were perfectly sound' timber and 80 per eent. of the. decking was sound enough to be reused. Decay, with a few exceptions, was limited to the ends of the boards. The bulk of the deterioration would only be apparent in the last 12 months. He estimated the cost of repairs to the whole stadium at £B4O/16/-, but if the city council insisted on full compliance with its requisition the cost would be £llOO. After hearing argument by counse., his Honour said he would take time to consider his decision.
