MURDER CHARGES
Jury Disagrees at Fourth Hearing ACCUSED REMANDED FOR FURTHER TRIAL (Received July 30, 12.45 a.m.) Melbourne, July 29. . The jury disagreed in the fourth’ trial of Rupert Davies and William John Cody, who are charged with having murdered James Edward Scrlven, Titles Office messenger, on January 31. The prisoners were remanded for a further trial. ’ This is the first occasion on which a person in Victoria has beeu tried four times for a capital offence. If the new trial proceeds it will be the first time in Australia that a person is presented for a fifth trial. Recent practice lias been to abandon the prosecution after three abortive trials. At the first trial the jury disagreed, and at the second the prisoners were found guilty and sentenced to death. Appeals to the Court of Criminal Appeals were dismissed, but. appeals to the High Court were upheld, and a new trial was ordered, which resulted in a disagreement.
