Auckland Gaming Charge

In a reserved judgment delivered today, Mr. C. R. Orr-Walker, S.M., convicted Francis Brewer of using buildings iu High Street as a common gaming-house but dismissed a further charge of being the occupier of the premises.
The magistrate said the prosecution failed to prove that Brewer was the real lessee or that a lessee called Rodney was really Brewer. “I understand the defendant has served jail,” said the magistrate, referring to the first charge, “but I don’t intend to imprison him this time. I have made up my mind to impose the maximum penalty unless there is a good argument to the contrary.” Counsel for the defendant said it was unnecessary for him to make any further remarks. The magistrate imposed a fine of £lOO and costs 10/-, adding: “I am assuming the defendant will give up the business.”
