CASE STRUCK OUT
Claim Against Singer and Vaudeville Artist Dominion Special Service. Palmerston North, March 24. The claim of Len Smith, pianist. Palmerston North, against Vincent Ryan, vaudeville artist, and Senia Chostiakoff, singer, was struck out by Mr. J. L. Stout. S.M.. to-day. when Mr. G. I. McGregor, for Smith, said that tie was satisfied Hint the defendants had a defence which would have been fatal to Smith's ease. The parlies were now on the best of terms. Il had been arranged that the action lie discontinued without costs to either side. For defendants, Mr. 11. R. Cooper said costs would not be asked for. This was a generous gesture, said Mr. Stout, striking tlie case out. Smith, in his claim, alleged wrongful dismissal and claimed £2lO damages. He set out that Chostiakoff and Ryan engaged him on October .13. 1936. to act as pianist for a concert, tour of New Zealand. estimated to last six months, at a salary of £lO a week. In the terms of Hie engagement he served from that date until November 29, when, he alleged, he was wrongfully dismissed. Ryan, Chostiakoff and Smith and their counsel wore present in court at tlie time of the special fixture arranged. After less than half an hour’s conference between the parties, the djUtrontiiiuaiice was announced to the magistrate.
