Man’s Offence Described as “Foolish Prank” MAGISTRATE’S COURT CASES What was described by his counsel as a “foolish prank” led to the appearance of John Doyle, clerk, 33 years, before Mr. E. D. Mosley, S.M., in the Magistrate's Court, Wellington, yesterday, on charges of the theft of 11/- in money, the property of Alfred Joseph Cartiichael, and of a breach of a prohibition order. On the theft charge accused was convicted and ordered to come up for sentence if called. upon within six months., and he was discharged for the breach of the prohibition order.

Senior-Sergeant J. Dempsey said that Mr. and Mrs. Carmichael had a small confectionery shop in Vivian Street. Shortly after 5 p.m. on Saturday they were sitting in a room just at the rear when Mrs. Carmichael saw a hand closing in the till. Mr. Carmichael rushed out and caught the accused, whom he held until the arrival of the police.. The money was refunded. Counsel for accused, Mr. P. Verschaffelt, submitted that it was one of those unfortunate eases. Accused had some friends who had given him liquor. It was not a question of his having gone on to licensed premises. “It is just one of those foolish pranks; he regrets what he has done, and he refunded the money immediately,” said counsel. Senior-Sergeant Dempsey said accused had £l/1/9 of his own in his possession at the time of the offence. Argument Ends in Fight. An argument on Saturday which led to two young men coming to blows was followed by their appearance yesterday, when they pleaded guilty to charges of striking one another. The accused were Peter Malcolm Miller, seaman, 22 years, and Keith Vivian Henry Howard, musician, 21 years. Both were fined 20/in default three days imprisonment. Ex-Jockey Again in Court. Appearing for the fourth time within six months to answer a charge of drunkenness, Frederick Arthur Carlyle, Kingan, alias “Dad” Kingan, ex-joekey and labourer, aged 62, was sentenced to three months’ imprisonment with hard labour. It was stated by Senior-Sergeant J. Dempsey that on July 29 accused had been convicted for being unlawfully on premises, and he was then ordered to come up for sentence if called upon within three months, and was sent to the Salvation Army Home at Miramar. After spending one night in the Home he left the next day, and on Saturday was again arrested for. being drunk. Asked by the magistrate if lie had anything to say Kingan said: Yes, it will never happen again if you will give me another chance.

Mr. Mosley: It won’t happen again for three months.
