Breach of Provisions Alleged The question whether a firm manufacturing concrete blocks and paving slabs was bound by the provisions of the Builders, Contractors and General Labourers’ Award was argued before Mr. J. 11. Luxford, S.M., in the Magistrate’.* Court, Wellington, yesterday. The case was one in which the Inspector of Awards proceeded against the Winget Concrete Block Company, Wellington (Mr. C. A. L. Treadwell) claiming a penalty of £l9 for alleged breach of the award by failing to pay the prescribed rates of wages to labourers. The Inspector of Awards, Mr. L. G. Goodacre, who prosecuted, said that tbe rate of pay to the workers employed ranged from 25/- to £2/2/- a week, the latter rate being paid to the foreman His department contended that the com puny was hound by that portion of the clause in the general labourers’ award referring to payment at 1/10 an hour for concrete work. The defence contended that the work performed by the company in the making of concrete blocks, breeze blocks and paving slabs was special and therefore did not come within the scope of the award. lt t was alio submitted that the company was not a party to the award in that it lisd been incorrectly cited. The magistrate said he would make an inspection and give a written judg ment.
