STORM - WATER TROUBLE
Plaintiff Succeeds Against Neighbours Judgment for the sum of £l4l/12/in favour of plaintiff was awarded by Mr. Justice Smith in a reserved decision given in the Supreme Court. Wellington, on Saturday, in a ease in which Hart Spear took action against Annie- Newham and Clara Rowlett, owners of a property adjoining but higher than that of plaintiff's property. Plaintiff sought damages and an injunction as a result of storm water which was alleged by him to have come down from defendant's property and caused damage to his own. The storm water was alleged to have brought down earth. His Honour said that as the nuisance had now been abated, no injunction was asked for. Costs were awarded to plaintiff on the lowest scale. Mr. T. C. A. Hislop appeared for plaintiff and Mr. W. H. Cunningham for defendants.
