CLAIM FOR DAMAGES
Pacer Injured by Bull

An action arising out of the loss of the pacing gelding Silver Bingen, which it was alleged had to be destroyed after it had been gored by a dangerous bull belonging to defendant, was heard in the Alagistrate’s Court to-day when the owner of the horse, Mrs. I. E. Sweetapple, claimed £152 damages, Including £2/2/- veterinary surgeon’s fee, from Hugh Hedley, farmer, of Auckland. In the statement of claim plaintiff said Silver Bingen had been delivered to defendant on April 13, and in return for earing for the horse he was to receive 5/- a week. It was- alleged that owing to defendant’s negligence the horse was attacked by a bull in tho same paddock, with the result that the horse bad to be destroyed on May 22. The defence was that there had been no contract between plaintiff and defendant and that defendant was not guilty of negligence. The case was adjourned until to-mor-row. ,
